By accessing and using Enhancia, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. User Account Responsibilities

• You are responsible for maintaining account confidentiality

• You are liable for all activities under your account
• You agree to notify us immediately of unauthorized access

User Obligations

• Provide accurate information during registration
• Update account information as needed
• Maintain password security and not share credentials
• Promptly notify us of unauthorized access

3. Acceptable Use Policy

Prohibited Activities

You agree not to:

• Upload or process illegal, harmful, or explicit content
• Use the service for illegal purposes or activities
• Attempt to gain unauthorized access to the system
• Reverse engineer, decompile, or modify the service
• Use automated tools to scrape or bulk download content
• Harass, threaten, or abuse other users
• Upload content that infringes intellectual property rights
• Conduct denial-of-service attacks or spam
• Impersonate others or provide false information
• Interfere with service operations or security

Content Restrictions

• No explicit or adult content
• No content violating third-party rights
• No malware, viruses, or harmful code
• No content promoting violence or discrimination
• No private or confidential information without consent

4. Intellectual Property Rights

• Enhancia retains all rights to the platform, code, and algorithms
• You retain ownership of original images you upload
• You grant us license to process and enhance your images
• You own the enhanced images produced by our service
• You are responsible for ensuring images don't infringe others' rights
• All trademarks and logos are property of Enhancia

5. Limitations of Service

Service Availability

• Service provided "as is" without warranties
• We aim for 99.5% uptime but cannot guarantee zero downtime
• Scheduled maintenance may temporarily interrupt service
• We reserve right to modify or discontinue features
• Emergency security measures may temporarily limit access

Quality Disclaimers

• Enhancement results depend on image quality and type
• We do not guarantee specific enhancement outcomes
• Results may vary based on input image characteristics
• Some image types may not be enhanceable

6. Payment & Subscription Terms

Pricing

• All fees are stated and charged in Australian Dollars (AUD) unless otherwise specified
• Prices are subject to change with 30 days notice
• Prices exclude applicable taxes
• Currency charges reflect current exchange rates

Billing

• Users may purchase image enhancement credits on a pay-as-you-go basis. Subscription billing occurs on a monthly or annual cycle depending on the plan selected at the time of purchase.
• You authorize us to charge your payment method
• Failed payments may result in service suspension
• You are responsible for keeping payment info current
• Invoices are available in your account

Free Trial

• Free trial provides 10 credits for testing
• Trial does not require payment information
• Trial credits expire three (3) days after account creation if the trial account is not converted to a paid plan
• No automatic charge at trial end

7. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Total liability shall not exceed amount paid in last 12 months
• We are not liable for data loss or corruption
• We are not liable for third-party actions
• We are not liable for service interruptions beyond our control

8. Termination

• You may terminate your account at any time
• We may terminate accounts for policy violations
• We may terminate for inactivity (180+ days)
• Upon termination, your data is deleted immediately
• Paid subscriptions are non-refundable upon termination

9. Governing Law

These terms are governed by and construed in accordance with the laws of the jurisdiction where Enhancia is registered, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

10. Changes to Terms

• We may modify these terms at any time
• Changes are effective immediately upon posting
• Continued use constitutes acceptance of changes
• Material changes will be announced via email
